The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.
The informant alleged that the petitioner took loan of Rs. 4,90,000/-, but did not return the same. When the cheque was presented the same was dishonoured.
It is submitted that the petitioner filed informatory petition about missing of his cheques bearing his signature. The petitioner never borrowed any money from the informant and taking advantage of blank cheque the informant concocted a story and filed this case.
Considering the facts aforesaid, the petitioner above
Patna High Court Cr.Misc. No.40693 of 2015 (2) dt.06-10-2015 2/2 named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Gaya Mufasil P.S. Case No. 184 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
