Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Gopalpur P.S. Case No. 122 of 2021 registered for the offence under Sections 363/366A of the Indian Penal Code and under Section 8 and 12 of the POCSO Act.

As per the prosecution case, on 23.08.2021 at about 9:00 A.M. in the morning when the daughter of the Informant was going to her school then all the accused persons collectively

Patna High Court CR. MISC. No.24019 of 2023(2) dt.18-05-2023 2/3 conspired and abducted the daughter of the informant for marriage or sell her. When the informant came to know about the same, he went to inquire about the same to Bhuneshwar Padit who is the father of main accused namely Pintu Kumar then he assured the informant that they would call the victim and the accused. After four days, the informant again went to Bhuneshwar Padit then the wife of the Bhuneshwar Padit Geniya Devi and their son and daughter collectively abused him and refused to give the victim girl back and said that her son Pintu Kumar had taken away his daughter.

Learned counsel for the petitioner submits that the petitioner submits that victim girl has stated in her statement made under Section 164 of the Cr.P.C. that she has married with the petitioner.

Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the statement of the victim girl, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge-POCSO-cum-ADJ-VI, Bettiah West
