2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 04.08.2023 passed in Cr. Misc. No. 45933 of 2023.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 147, 149, 341, 323, 325, 302 and 504 of the Indian Penal Code.

4. The following order was passed on 04.08.2023 in Cr. Misc. No. 45933 of 2023:- Heard the learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Chainpur P.S. Case No. 33 of 2023 registered for the offence under Sections 147, 149, 341, 323, 325, 302 and 504 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is assailant of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 25.04.2023, he is quite innocent and has not committed any offence.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the materials available on record, I am not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed with direction to the Court below to expedite the trial of the petitioner.

5. Petitioner is the assailant of the deceased. No ground for review is made out.

6. Accordingly, this application for regular bail is hereby rejected.

7. The court below is directed to expedite the trial of the petitioner.
