The petitioner seeks bail in connection with Runisaidpur P.S. Case No. 541 of 2018/ G.R. No. 4008 of 2018 for the offence under Sections 363, 366(A), 34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. According to the statement recorded under Section 164 Cr.P.C., the informant has stated that nobody has kidnapped her and she herself went out of her house with the petitioner, which is evident from annexure-2. No specific overt act is attributed

Patna High Court Cr.Misc. No.78792 of 2018(2) dt.25-01-2019 2/2 against the petitioner and he is rotting in custody since 27.09.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Runisaidpur P.S. Case No. 541 of 2018/ G.R. No. 4008 of 2018.
