2. Petitioner seeks bail, who is in custody since 15.07.2022, in connection with S.Tr. No. 1383 of 2022 arising out of Shashtri Nagar P.S. Case No 414 of 2022, FIR dated 03.07.2022 registered for the offenses punishable under Section 302 and 34 of the Indian Penal Code.

3. The prosecution case, in brief, is that the petitioner along with other co-accused persons assaulted the brother of the informant with the knife due to which the he died.

4. Earlier the petitioner has moved before this Hon'ble Court in Cr. Misc. 10857 of 2023 and the same was

Patna High Court CR. MISC. No.30276 of 2024(3) dt.11-07-2024 2/2 dismissed vide order dated 02.08.2023, thereafter, petitioner again moved before this Hon'ble Court in Cr. Misc. No. 5741 of 2024 and the same was withdrawn with the liberty to move before the learned Trial Court.

Vide order dated 26.04.2024 a report was called with regard to the stage of trial and the report dated 15.05.2024 of the learned trial court reveals that out of seven charge sheet witnesses four witnesses have been examined and the case is pending for the examination of the rest three prosecution witnesses.

6. Considering the aforesaid facts, and the report of the learned trial court, I am not inclined to enlarge the petitioner on bail, however, learned trial court is directed to expedite and conclude the trial at the earliest in connection with S.Tr. No. 1383 of 2022 arising out of Shashtri Nagar P.S. Case No 414 of 2022.
