2. As per the allegation, on the report of deceased Ghanshyam Malakar (Chowkidar), co-accused Sonu Kumar and Narayan Mukhiya were arrested with illicit liquor. Narayan Mukhiya died in jail and according to the allegation the co-accused persons had threatened to kill Ghanshyam Malakar. Thereafter the accused persons including the petitioner committed murder of Ghanshyam Malakar.
3. At the very outset, learned counsel for the petitioner has submitted that during investigation nothing emerged which shows the implication of the petitioner in the alleged occurrence and on exactly similar footing co-accused Pappu Mukhiya and Kundan Mukhiya in Cr. Misc No. 80434 of 2024 and Sonu
Patna High Court CR. MISC. No.22480 of 2025(2) dt.27-06-2025 2/2 Kumar in Cr. Misc. No. 81233 of 2024 have been granted bail by a co-ordinate Bench of this Court vide order dated 16.06.2025.
4. On the other hand learned APP for the State has opposed the prayer for bail.
5. Considering the above-mentioned facts and circumstances, let the petitioners above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class cum AM, Khagaria in connection with Beldour P.S. Case No. 372 of 2023 subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
