JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with G.O. Case No. 1037 of 2018, arising out of Ghanshyampur P.S. Case No. 179 of 2018 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 22.11.2018. He further submits that in the instant case 90 litres foreign liquor was seized. He further submits that the alleged liquor was recovered from an abandoned house and not from the physical possession or from the house of the petitioner. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-

Patna High Court Cr.Misc. No.642 of 2019(2) dt.17-01-2019 2/2 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judge-cum-Special Judge, Excise, Darbhanga in connection with G.O. Case No. 1037 of 2018, arising out of Ghanshyampur P.S. Case No. 179 of 2018.
