2. The present revision petition has been preferred against the order dated 12.10.2018 passed by learned Additional Sessions Judge-6th, Buxar (Bihar) in Criminal Appeal Nos. 64 of 2017 and 65 of 2017 whereby the order dated 29.05.2017
Patna High Court CR. REV. No.15 of 2019(14) dt.24-02-2025 2/3 passed by learned Sub Divisional Judicial Magistrate, Buxar, in Cr. Misc. No. 3 of 2016 has been set aside, though, Seema Thakur is permitted to reside in her Sasural as per share of her husband.
3. It is also pertinent to mention here that there is dispute between the parties under the Protection of Women from Domestic Violence Act, whereby the Complainant/wife is seeking residence besides maintenance and protection. However, learned counsel for both the parties informed the Court that the matter has been amicably settled between husband and the wife and a compromise petition dated 4.12.2024 has also been filed in the court of learned SDJM, Buxar and as per the settlement, the husband has paid Rs.15,00,000/- to his wife Seema Thakur. It is also promised that he will keep paying Rs.15,000/- per month to his wife till her life. It has also been settled between the parties that the husband will construct the house at Dumraon for residence of his wife within five years. It has also been agreed between the parties that nobody will interfere in their personal life and they will withdraw their all pending cases. In pursuance of their settlement, they have already filed application before learned SDJM, Buxar, for withdrawing the complaint besides filing a
Patna High Court CR. REV. No.15 of 2019(14) dt.24-02-2025 3/3 copy of the agreement in Cr. Appeal No. 62 of 2016 pending in the court of learned Additional Sessions Judge, VII, Buxar, in 498-A I.P.C. filed by the wife against her husband and his family members.
4. Certified copy of the settlement between the parties has been filed across the board and the same is taken on record.
5. In view of the aforesaid settlement between the parties, learned counsel for the petitioner is seeking permission to withdraw the present petition.
6. Permission is accorded.
7. Accordingly, the present petition is dismissed as withdrawn in view of the aforesaid settlement between the parties.
