Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 307, 326, 326(A), 326(B), 34 of the Indian Penal Code.

Learned counsel for the informant submits that five persons including the informant of the case have already been examined in this case and only the Doctor and Investigating Officer are to be examined.

Considering the fact that the trial is likely to conclude very soon, I am not inclined to enlarge the petitioner on bail considering the nature of allegation which is extensively discussed in the order dated 12.06.2019 passed in Cr.Misc. No.26550 of 2019 whereby prayer for bail of the petitioner was refused.

No.27736 of 2020(3) dt.24-02-2021 2/2 Hence, prayer is refused in connection with S.T.No.73 of 2019 arising out of Muffasil P.S.Case No.162 of 2018 pending in the court of learned Sessions Judge, Munger. The learned District Judge, Munger is directed to transfer the trial in a functional court if it is still pending in the vacant court.

The informant/prosecutor shall ensure production of prosecution witnesses on each and every date before the learned Trial Judge and the learned Trial Judge shall not allow any unnecessary adjournments in the case.
