====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 02-11-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner apprehends arrest in Konch P.S. Case No. 156 of 2015 dated 29.07.2015 instituted under Sections 341/323/324/337/379/353/34 of the Indian Penal Code. The allegation against the petitioner along with others is of pelting the police party with stone when they had gone to conduct a raid with regard to sale of illicit liquor from his house.
Learned counsel for the petitioner submits that it was the shop of the son of the petitioner for which he cannot be held
Patna High Court Cr.Misc. No.47592 of 2015 (2) dt.02-11-2015 2/2 responsible and further being an old man having no criminal antecedent, he deserves the privilege of anticipatory bail. Learned A.P.P. opposes the prayer for anticipatory bail and submits that as per the allegation the petitioner, his son along with others prevented the police from conducting a raid by pelting stone and such conduct being a direct affront to the authority of the State is not fit to be condoned and the petitioner does not deserve indulgence by granting anticipatory bail. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on anticipatory bail. The application, accordingly, stands dismissed. However, in the event the petitioner surrenders and prays for regular bail before the court concerned, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order.
