On the facts of the case the petition may not appear meritorious.

However, it was pointed out by the learned counsel for the petitioner that compromise has been struck between the spouses and a petition is likely to be filed before the court below. Patna High Court Cr.Misc. No.38493 of 2012 (7) dt.26-02-2015 2 / 2 compliant petition No. 37 ( C) of 2011, pending in the court of Sub-Divisional Judicial Magistrate, Masourhi at Patna within a maximum period of six months.

It is directed that if the complainant appears before the court below she should be examined as the first witness and if she says that she has compromised the matter, no further witness shall be examined and the case shall be disposed of on that evidence.
