JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-08-2015 Heard learned counsel for the petitioner, learned counsel for the complainant as well as learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Complaint Case No. 422-C of 2012 in which cognizance has been taken for the offences punishable under Sections 406 & 420 of the Indian Penal Code.

Petitioner happens to be Director of concerned company which got investment of complainant and several others. It would appear from perusal of para-3 of the petition that several cases were registered against the petitioner.

Patna High Court Cr.Misc. No.31945 of 2014 (6) dt.26-08-2015 2/2 Learned counsel appearing for the petitioner submits that petitioner has already remained in jail custody for more than two and half years in connection with other cases. Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Complaint Case No. 422-C of 2012 pending in the court of Sri Amit Kumar Pandey, Judicial Magistrate 1st Class, Bettiah, West Champaran stands rejected.

However, the learned court below shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
