JUSTICE RAVI RANJAN ORAL ORDER 05-09-2016 I have heard learned counsel for the petitioner and the State.

The petitioner apprehends his arrest in a case registered for offences punishable under Sections 147, 159 and 153 of the Railway Act.

It is contended that the petitioner is not named in the F.I.R., however, during the course of investigation, it came to the notice that the motorcycle, which met with an accident with running train as the same was parked beside the railway track, belonged to the petitioner. It is contended on behalf of the petitioner that he was running Suruchi Automobile which was authorized dealer of Bajaj vehicle of two and three wheelers. He

Patna High Court Cr.Misc. No.31717 of 2016 (2) dt.05-09-2016 2 / 2 has sold the motorcycle to one Ashok Kumar Singh. Copies of the cash memo and chassis number was also given by him which has been disbelieved by the authority. It is further contended that motorcycle has been smashed by engine of the train but it has not caused any injury to any person. It is lastly contended that the antecedent of the petitioner is clean.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Saroj Singh be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Buxar R.P.F. Case No. 1523 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Ara subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
