The petitioner apprehends his arrest in Excise Case No. C/7-9/2015, registered for the offences punishable under Section 47(A) of the Excise Act.

On raid six bottles Blenders Pride each containing 180 ml and eight bottles of Imperial Blue each containing 180 ml were recovered from the shop of the petitioner. It is alleged that the petitioner kept the same for sale, but the petitioner has got no license.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.

However, the petitioner, if so advised, may surrender

Patna High Court Cr.Misc. No.40723 of 2015 (2) dt.06-10-2015 2/2 before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit on the same day without being prejudiced by this order.
