JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-08-2016 Heard the counsel for the petitioner and the State. This is repeat application on behalf of the petitioner seeking anticipatory bail in Morkahi P.S. Case No. 62 of 2013 registered under section 366-A of IPC. Earlier, her application for anticipatory bail was permitted to be withdrawn. It is stated that one of the kidnapped person, namely, Chandan Kumar has been recovered whose statement was recorded in which no direct allegation has been levelled against the petitioner. The petitioner deserves the privilege of anticipatory bail.
The learned APP opposed the prayer and submitted that another abducted person is still traceless. Learned Sessions Judge has recorded that in course of investigation materials collected
Patna High Court Cr.Misc. No.30796 of 2016 (2) dt.09-08-2016 2/2 support the prosecution case. The petitioner has not submitted to the jurisdiction of the court for which permission was sought and granted by the Court under order dated 23.06.2014. Looking to the materials on record including the severity/gravity of the allegation levelled against the petitioner, I do not find a case for grant of anticipatory bail is made out. The application is rejected.
