JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 Petitioner seeks regular bail in connection with Sarsi P.S. Case No.81 of 2016, G.R. No.3801 of 2016 registered for the offences punishable under Sections 363, 366(A), 372/34 of IPC.

Prosecution story is of enticing the minor daughter of the informant. It further appears that the occurrence is on 20.03.2016 and her recovery was made on 21.03.2016 and the first information report was lodged on 20.11.2016. Submission of the learned counsel for the petitioner is that there is a delay of nine months in lodging the F.I.R. and further prior to that a misc. petition was filed by the petitioner that she has not supported the prosecution case of enticing, however later on, on the pressure of informant she has made statement against the petitioner in her statement under Section

Patna High Court CR. MISC. No.25205 of 2019(3) dt.22-05-2019 2/2 164 of Cr.P.C. Further submission is that petitioner is in custody for about three months and the charge sheet has already been submitted as such, there is no chance of tampering with the evidence. It is also submitted that the age of the girl was 25 years Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri Rohit Kumar, learned Judicial Magistrate, 1st Class, Purnea, in connection with Sarsi P.S. Case No.81 of 2016, G.R. No.3801 of 2016, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
