2. The petitioner has preferred this application for grant of regular bail in connection with G.B. Nagar Siwan P.S. Case No. 311 of 2024 dated 18.06.2024 registered for the offences punishable u/ss 302 and 201 read with section 34 of the Indian Penal Code and 27 of the Arms Act.
3. As per the prosecution case, on 18.06.2024, his grandson received a call on his mobile and while leaving the house, on being asked by the informant, he disclosed that he was called by Ankit, Sachin and Manish (the petitioner) and thereafter left the house, further at 8 P.M., he received

No.25495 of 2025(2) dt.05-05-2025 2/3 information that his grandson was shot and police has taken him to hospital, accordingly he reached Sadar Hospital, Siwan where he came to know that his grandson was killed, thus the informant alleged that he had suspicion that Ankit, Sachin and Manish had called his grandson and killed him.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is no eyewitness to the alleged occurrence. The allegation against the petitioner is of calling the informant's grandson by telephone. Similarly situated co-accused has already been granted anticipatory bail by the co-ordinate bench of this court vide order dated 28.03.2025 passed in Cr. Misc. No. 12797 of 2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 20.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court
Patna High Court CR. MISC. No.25495 of 2025(2) dt.05-05-2025 3/3 concerned, Siwan in connection with G.B. Nagar Siwan P.S. Case No. 311 of 2024, with a condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
