The petitioners seek bail in a case registered for the offence punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.
Allegation upon the petitioners and co-accused is that with intention to kill the informant, they have assaulted the informant and his relative with knife and firearm. Learned counsel for the petitioner submits that petitioners are innocent and have been falsely implicated in this case. He submits that there is case and counter case between the
Patna High Court CR. MISC. No.21601 of 2020(4) dt.06-10-2020 2/2 parties and both sides have received injury. He submits that charge-sheet has already been submitted and there is no allegation of tampering with the prosecution witnesses by the petitioners. He further submits that petitioners bear no criminal antecedent and they are languishing in judicial custody since 09.02.2020.
In the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Dinara (Bhanas) Police Station Case No. 36 of 2020.
