In the present writ petition the petitioner has made a prayer for quashing of Annexure - '1' to the writ petition to the extent of shifting the date of benefit of grant of A.C.P. He submits that after the order impugned the petitioner had filed a detailed representation before the Chief Engineer vide Annexure - '3' to the writ petition. However, till date no decision has been taken.

In view of the facts and circumstances, particularly the fact that representation of the petitioner has not been decided till

Patna High Court CWJC No.18404 of 2011 (4) dt.27-04-2016 2/2 date, without going into the merit of the case , the Court proposes to dispose of the present writ petition granting liberty to the petitioner to file fresh representation. If such representation is filed within a period of eight weeks from today, the Court expects that the respondent no. 4 may examine the same and pass appropriate order preferably within a period of three months after filing of such representation.
