====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 09-11-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 506 and 307 of the Indian Penal Code.
The informant alleges that on account of dispute related to cleaning of drain, the accused persons came and abused, on protest petitioner along with accused persons assaulted him, further, on orders of Mahendra, Bhagwan fired causing injury on his right hand and heart when villagers gathered, accused fled away. Learned counsel for the petitioner seeks permission to withdraw the anticipatory bail application with respect to petitioner No. 2.

Learned counsel further submits that petitioner is a person with clean antecedent and has been falsely implicated in the present case, it is next submitted that specific allegation of firing is against Bhagwan, it is next submitted that petitioner is a railway employee and on the date of occurrence he was on duty at Patliputra Railway Station as it would be evident from Annexure 2 series to the anticipatory bail application.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bagen Gola P.S. Case No. 15 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
