====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-07-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in Shahkund P.S. Case No. 228 of 2023 registered for the offences punishable under Sections 302, 120B, 34 of the Indian Penal Code.

3. As per the FIR, all the accused persons including this petitioner are said to have killed the informant's daughter.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. No such occurrence as alleged has ever taken place. The petitioner is brother-in-law of the deceased. He has been falsely implicated in this case due to ulterior motive. The allegation levelled against the petitioner is totally false and

Patna High Court CR. MISC. No.27578 of 2024(4) dt.12-07-2024 2/2 based on concocted facts. He is not even present at the place of occurrence, rather he was in Ludhiyana for his livelihood. He has no concern with the alleged occurrence. There is no material in the case diary to show the complicity of the petitioner in the alleged occurrence. He has one criminal antecedent and he is in custody since 30.01.2024

5. Learned APP for the State opposed the prayer for bail.

6. Considering the facts and circumstances of the case, since there is nothing against the petitioner in the entire case diary, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Shahkund P.S. Case No. 228 of 2023.
