JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-04-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as the learned APP for the State.

The petitioner apprehends his arrest in connection with Complaint Case No. 119 (C) of 2018, registered for the offences punishable under Sections 498 A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.

This is a case of matrimonial dispute. As per allegation, the petitioner (husband) and in-laws subjected the victim to cruelty for non-fulfillment of dowry demand.

He has also submitted that the marriage between both the parties has been declared null and void as per Annexure-3 page-30, which is xerox copy of order of learned Additional Principal Judge/family court, Bengaluru M.C. No. 5951 of 2017.

To explore amicable settlement of the issue, the notice was issued to the victim but she did not appear. Considering these facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,Bhojpur at Ara in connection with Complaint Case No. 119 (C), subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
