JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 498A and 379 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of the dowry demand.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant. It is further submitted that though, the petitioner has performed second marriage but the informant has also performed second marriage. The impugned order suggests that anticipatory bail application of the petitioner was rejected by learned Sessions Judge on 18.06.2013 but the present bail application has been

Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Ashok Paper Mill P.S. Case No. 48 of 2013 pending in the court of learned SDJM, Darbhanga. Accordingly, the application is disposed of.
