The petitioner seeks pre-arrest bail in connection with Bhagwanpur P.S. Case No.202 of 2014 registered under Sections 304B and 201/34 of the Indian Penal Code.
It is contended by the learned counsel for the petitioner that the petitioner has got no concern with the deceased or her husband. He is a co-villager of the husband of the deceased. The other accused persons named in the FIR namely, Dwarik Paswan, Bedamiya Devi, Sanjay Devi and Manju Devi have already been granted pre-arrest bail by a Bench of this court vide order dated 18.2.2016 passed in Cr.Misc. No.42751 of 2015 as contained in
Patna High Court Cr.Misc. No.28839 of 2016 (2) dt.25-07-2016 2/2 annexure-2 to the present application.
Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner. Regard being had to the facts and circumstances of the case as also to the reasons assigned in the aforesaid order, in the event of arrest or surrender in the court below within six weeks from today, the petitioner, namely, Jairam Paswan, is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/concerned court, Vaishali at Hajipur in connection with Bhagwanpur P.S.Case No.202 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
