2. The present writ petition has been filed by the petitioner for measurement and demarcation of his land as well as prayer of possession has been made, but in the argument, he submits that he is not pressing his relief for possession, but seeking direction to the respondents only for measurement and demarcation of his land.
3. Counsel for the State submits that under Rule 23 of the Bihar Tenancy Rule, 1885 any persons have right to move for measurement of their lands upon payment of requisite fee.
4. In this view of the matter, this writ petition stands
Patna High Court CWJC No.17514 of 2015(2) dt.01-09-2023 2/2 disposed of directing the petitioner to file an application before the Circle Officer, Thakurganj, Kishanganj under Rule 23 of the Bihar Tenancy Rule, 1885. He is also directed to deposit requisite fee for the same.
5. The Circle Officer, Thakurganj, Kishanganj is directed to complete the measurement within 90 days after filing of the application.
6. With the aforesaid direction, the present writ application is hereby disposed of.
