The petitioner is apprehending his arrest in Rajauli P.S. Case No. 33 of 2015, registered for the offences punishable under Sections 363, 366(A) of the Indian Penal Code. The allegation against the petitioner is that one Vicky Kumar who is said to have in the love affair with the victim girl had kidnapped her and in this act the petitioner Rupesh Yadav and others had assisted him.
Learned counsel for the petitioner submits that the petitioner along with other accused persons have been falsely implicated in the case. It was only Vicky Kumar who was in love affair with the victim girl, who was subsequently recovered. It is
Patna High Court Cr.Misc. No.30583 of 2016 (2) dt.29-08-2016 2/2 further submitted that other co-accused persons, namely Birendra Yadav and Devan yadav have been extended the privilege of anticipatory bail in Cr. Misc. No. 15803/2016 vide order dated 16.05.2016.
Considering the aforementioned facts and circumstances and that the petitioner is having no criminal antecedent, let the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Nawadacum-Special Judge, POCSO in connection with Rajauli P.S. Case No. 33/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
