Petitioner seeks bail in a case registered for the offences punishable under Section 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 109, 114, 117, 427, 435, 379, 504, 506 & 511 of the Indian Penal Code as well as Section 3 of Damage of Public Property Act.
The petitioner is alleged to be a member of a mob that had allegedly attacked the house of the Gram Pradhan as well as some Government officials in relation to a dispute that had arisen alleging that one person who was reported to be a child lifter was being protected by the Gram Pradhan. The petitioner being part of the mob has also been
Patna High Court Cr.Misc. No.1748 of 2019(2) dt.18-01-2019 2/2 prosecuted. It has been stated that two other co-accused, namely Bhogendra Mandal and Rajesh Ram @ Rakesh Ram, who were also part of the mob with similar allegation, have been granted bail by a co-ordinate Bench of this Court on 26.09.2018. A copy of the said order is Annexure-2.
In the background aforesaid and keeping in view the omnibus nature of allegation, let the petitioner, above named, be also enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti in connection with Bisfi (Patauna ) P.S. Case No.129 of 2018.
