2. Learned counsel for the petitioner is permitted to make correction in para 4 of the petition.

3. The petitioner has preferred this application for grant of regular bail in connection with Dhaka P.S. Case No. 210 of 2025 registered for the offences punishable under Sections 103(1) and 3(5) of the B.N.S.

4. As per the allegations, on the plucking of tomato, a quarrel took place between the parties and as per the allegation, petitioner and co-accused Safrullah struck fists on the head of the father of the informant, as a result of which he died on the spot.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that occurrence took place suddenly, without any premeditation to kill, and the postmortem report does not support the prosecution's allegations rather, the case of death has been opined to by heavy hard and blunt substances. It has further been submitted that the petitioner is an old man, aged about 63 years, and the charges has been framed in this case, and the petitioner under takes to co-operate in the trial. It has lastly been submitted that the petitioner has got no criminal antecedent and is in custody since 15.06.2025. It has further been submitted that there is no allegation of tampering against the petitioner and that, in fact, the deceased was also an old man, and he fell on the hard surface during the intervening quarrel and succumbed to the injuries.

6. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

7. Considering the aforesaid submissions of the parties and taking into account the facts and circumstance of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
