The petitioner apprehends his arrest in connection with Jagdishpur Police Station Case No.166 of 2015 registered under Sections 409 and 420 of the Indian Penal Code, pending in the court of Shri Navin Kumar Srivastava, Judicial Magistrate, First Class, Bhojpur at Ara.
The allegation is that Rs.9,10,000/- was allotted for the construction of the building of the Primary School, Mahtati, Jagdispur, and the petitioner being the Incharge Headmaster of the said School withdrew the said amount and made construction work up to grade beam of the cost of Rs.1,72,000. While
Patna High Court Cr.Misc. No.50562 of 2015 (3) dt.07-12-2015 2/2 Rs.1,50,000/- was withdrawn by the petitioner for the construction of the boundary wall of the said School but the same has not been completed.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court on its own merit without being prejudiced by the order of this Court.
