JUSTICE SHIVAJI PANDEY ORAL ORDER 15-04-2015 As per order dated 25.3.2015 learned counsel for respondent no.5 has brought two account payee cheques vide Cheque nos.141375 dated 25.3.2015 and 141373 dated 23.6.2015 in the name of Most. Shobha Devi amounting to Rs.4,00,000/- by way of full and final payment as petitioner was agreeable to settle the dispute subject to payment of Rs. 4,00,000/-.
Both the cheques are being handed over to the petitioner who is physically present in Court and she is identified by the learned counsel for the petitioner.
It is made clear that if the aforesaid cheques are returned by the Bank on the ground of insufficient fund, it will be treated that respondent no.5 has committed a court of contempt and on simple filing of the application in the present case itself
Patna High Court CWJC No.15695 of 2012 (14) dt.15-04-2015 the case will be revived and directly a contempt proceeding would be drawn against respondent no.5.
