JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-07-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State of Bihar.
This application, for grant of anticipatory bail, arises out of Shakurabad Police Station Case No. 121 of 2016, disclosing offences under Sections 341/323/337/338/ 307/379/504/34 of the Indian Penal Code.
It is evident form the First Information Report that the petitioners and the informant are agnates. Learned Counsel for the petitioners has submitted that the allegation is of assaulting the informant with bricks and stones. He has also submitted that considering the nature of accusation, no offence under
Patna High Court Cr.Misc. No.25655 of 2017 (2) dt.10-07-2017 2/2 Section 307 of the Indian Penal Code is said to be made out.
Considering the background in which the First Information Report has been registered, in my view, a case for grant of privilege of anticipatory bail is made out. This application is, accordingly, allowed.
Let the petitioners, Shravan Kumar @ Shravan Sao and Deepak Sao, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Judge I, Jehanabad, in connection with Shakurabad Police Station Case No. 121 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
