JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-06-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 307, 386/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, co-accused Chhotu Singh was demanding extortion from Ashok Shah near the betel shop. Both of them were quarreling with each other and thereafter, Chhotu Singh shot Ashok Shah with his pistol which hit in the temple of Ashok Shah It is submitted on behalf of the petitioner that specific accusation of causing fire arm injury is against co-accused Chhotu Singh. So far as this petitioner is concerned, this petitioner was simply present at the place of occurrence near betel shop. The petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Purnea in connection with Barhara P.S. case no. 619 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
