2. The petitioner apprehends his arrest for the offences alleged under Sections 420, 406, 409, 467, 468 and 120(B)/34 of the Indian Penal Code registered in connection with Complaint Case No. 879 of 2018.

It is submitted that the petitioner has been falsely implicated by the complainant who was working as the Sub-Kiosk Operator, appointed by N.G.O on the recommendation of the petitioner who was running a Grahak Seva Kendra of S.B.I. The complainant had earlier admitted that he had withdrawn money of the investors and assured to return the same on 05.03.2018 as stated by him (Annexure-4). Later on, the petitioner filed a complaint in Complaint Case No. 683 of 2018 ( Annexure-2) against the complainant and in retaliation thereof, the present complaint has been filed on 11.09.2018. The petitioner has been made accused in one

Patna High Court CR. MISC. No.24268 of 2019(2) dt.19-04-2019 2/2 prior case along with the present complainant under mis-impresssion of the petitioner's involvement.

Be that as it may, in the event of the petitioner's arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -II, Bagaha in connection with Complaint Case No. 879 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. and with further conditions -- (i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. BT/- (Vikash Jain, J) U T
