====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-05-2023 Heard Mr. Ajit Kumar, learned counsel appearing on behalf of the petitioners and Mr. Upendra Kumar, learned A.P.P. for the State.
2. The petitioners apprehend their arrest in connection with Trial No. 312 of 2023 arising out of C. No. 3402 of 2019 for the offence punishable under Sections 498(A), 323, 341, 504 and 379 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. The prosecution case, in brief, is that after the marriage, the complainant was kept properly in her matrimonial house only for nine months, thereafter, accused persons named in the complaint petition started demanding Rs. Ten lacs and a four wheeler in dowry. It is further alleged that
Patna High Court CR. MISC. No.23779 of 2023(2) dt.10-05-2023 2/2 accused persons started torturing her in various ways and lastly on 11.03.2019, they turned her out from her matrimonial house after snatching her personal belongings.
4. Learned counsel appearing on behalf of the petitioners submitted that petitioners are mother-in-law and father-in-law of the complainant and the husband of the complainant has been granted bail by the learned court below.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Considering the nature of allegation against the petitioners, who are mother in law and father in law of the complainant, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Saran at Chapra in connection with Complaint Case No. 3402 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
