The petitioner apprehends his arrest in a case under Sections 366, 376/34 of the Indian Penal Code. The informant victim alleged that she was kidnapped while she had gone to attend the call of nature and the petitioner committed rape with her. It is submitted that the informant was earlier married in the year 2011 but she left her matrimonial house. The informant made false allegation of committing rape only with a view to pressurize the petitioner to solemnize marriage. A Panchayati was also held and the father of the complainant admitted that the allegation made by his daughter is false and concocted but it appears from perusal of the record that the victim made a very specific allegation that the petitioner kidnapped her and committed rape with her.

Patna High Court Cr.Misc. No.16201 of 2014 (8) dt.09-12-2015 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Barharia P.S. Case No. 344/12. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) Dilip/- U T
