For the Petitioner/s : Mr. Amrendra Kumar For the Opposite Party/s : Mr. Sri Abhay Kumar Roy ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-09-2016 Heard both sides.
The petitioners apprehend their arrest in Jhajha P.S. Case No. 86 of 2016, registered for the offences punishable under Sections 354 (B) and other Sections of the Indian Penal Code. The informant alleged that while his daughter was going to worship of Goddess Durga, four boys abused her and caught her hand and asked her to sit at the rickshaw. The petitioners tried to drag her into auto rickshaw in which her clothes were torn.
Learned counsel for the petitioners submits that Sankri Devi, mother of petitioner no. 1 filed SC/ST Case No. 22 of 2016 against the informant and others.
Patna High Court Cr.Misc. No.30000 of 2016 (2) dt.08-09-2016 2/2 It appears that the victim made very specific allegation that four persons abused her and dragged her into rickshaw while she was going to worship. The victim identified the petitioners. Considering the nature of allegation made against the petitioners, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Rakhi U T
