ANJANA MISHRA ORAL ORDER 21-02-2019 Heard the learned counsel for the petitioner, learned counsel appearing on behalf of the State and learned counsel appearing on behalf of the informant.
The petitioners are in custody since 08.09.2018 in connection with Bhagwanpur P.S. Case No.181 of 2018, registered under Sections 363, 368 of the Indian Penal Code. Learned counsel for the petitioner submits that these petitioners had purchased baby child and had been taking good care of it when it was discovered that the child was a stolen baby and, therefore, child was recovered from the possession of these petitioners. It is submitted that these petitioners have no fault on their own and they are wiling to cooperate in any
Patna High Court Cr.Misc. No.80133 of 2018(4) dt.21-02-2019 2/2 further investigation and also face the trial. It is further submitted that they are not having any criminal antecedent and now that the child has been handed over to its original parents, the petitioners may be released on bail.
In view of the aforementioned facts and circumstances of the case and as per the submissions of the informant the child has admittedly been recovered, let the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, in connection with Bhagwanpur P.S. Case No.181 of 2018.
