JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-07-2017 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Paroo Police Station Case No. 196 of 2016, disclosing offences under Section 409/34 of the Indian Penal Code.

The petitioner has been made accused as he failed to make available certain documents to the Vigilance Team, investigating case of fraud in appointments to the posts of Shiksha Mitra/Panchayat Teachers. The petitioner is the Panchayat Secretary of Bishunpur Saraiya Gram Panchayat, in the district of Muzaffarpur.

Learned Counsel for the petitioner has submitted that the petitioner had not taken over the charge of the said document from his predecessors, Dayanand Jha

Patna High Court Cr.Misc. No.25792 of 2017 (2) dt.11-07-2017 2/2 and Bhikhari Rai. He also submits that those persons have since made available the documents to the District Programme Officer and they have been allowed anticipatory bail by this Court.

Considering the above submission, this application is allowed.

Let the petitioner, Naresh Sharma, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri A. K. Singh, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Paroo Police Station Case No. 196 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
