JUSTICE SATYAVRAT VERMA ORAL ORDER 20-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.02.2022, charge-sheet has been submitted in the case and has antecedent of six cases. Allegation is of recovery of 20 litres of country-made liquor from a plastic bag from the possession of the petitioner. Learned counsel for the petitioner submits that the petitioner was falsely implicated in the present case because of his antecedent, nothing was recovered from his possession, the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 19.02.2022 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kadamkuan P.S. Case No. 92 of 2022, Special Case No. 1008 of 2022.
