The petitioners apprehend their arrest in Puraini P.S. Case No. 73/2016, registered for the offences punishable under Sections 307 and other Sections of the Indian Penal Code. The informant alleged that on 11.06.2016, 13 accused persons including the petitioners came. Boku Singh assaulted the informant with iron rod. Bhakul Singh assaulted the informant with axe on her head. Then daughter of the informant came, Tikuli
Patna High Court Cr.Misc. No.26302 of 2017 (2) dt.13-07-2017 2/2 Singh is said to have assaulted the daughter of the informant with Lathi.
Learned counsel for the petitioners submits that the occurrence took place on 11.06.2016, but the F.I.R. was lodged on 06.09.2016, i.e., after three months of the occurrence. The petitioners Boku Singh and Bhakul Singh are not the petitioners, who are alleged tohave assaulted the informant with iron rod and axe. Tikuli Singh, Petitioner no. 3 is alleged to have assaulted the daughter of the informant with Lathi, but there is no injury report of daughter of the informant.
Considering the facts aforesaid, the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Puraini P.S. Case No. 73/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
