The petitioners seek bail in connection with Bahera P.S. Case No. 484 of 2018 registered under Sections 30(a), 32(iii), 41(i) of the Bihar Prohibition and Excise Act2016. 28 lts. of foreign liquor is said to have been recovered from the house of the petitioners and they were apprehended.
It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from conscious physical possession of the petitioners. They have no concern with the seized liquor. They have been falsely
Patna High Court Cr.Misc. No.80010 of 2018(2) dt.18-01-2019 2/2 implicated in this case. The house of the petitioners is inhabited by several other family members and they had no knowledge of keeping of liquor in the house. There is no compliance of Section 100 Cr.P.C. They have no criminal antecedent and have been languishing in custody since 7.11.2018.
Learned APP opposed the bail prayer of the petitioners.
In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV-cum-Special Judge, Darbhanga in connection with Bahera P.S. Case No. 484 of 2018.
