JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 11428 of 2018, arising out of P.R. (Nadi) P.S. Case No. 193 of 2018 for the offence under Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that in the instant case 100.76 litres of country made liquor was recovered from the shop of the petitioner. He further submits that the shop does not belong to the petitioner. He also submitted that the petitioner has got no criminal antecedent and he is in custody since 01.12.2018.

Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to

Patna High Court Cr.Misc. No.1310 of 2019(2) dt.28-01-2019 2/2 be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 11428 of 2018, arising out of P.R. (Nadi) P.S. Case No. 193 of 2018.
