ANJANA MISHRA ORAL ORDER 15-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. No one appears on behalf of the informant to oppose the present bail application.

The petitioner is in custody since 01.01.2019 in connection with Panapur P.S. Case No.01 of 2019 registered for the offence under Sections 406, 420, 467, 468, 471, 384/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been in jail custody for over nine months and he is willing to repay the amount once he is extended the privilege of bail. Learned counsel for the petitioner further submits that since the petitioner is a poor person, some instalments may be fixed so as to enable him to pay at regular intervals and he undertakes to appear in the court as and when

Considering the aforementioned facts and circumstances and that the petitioner has extended a bona fide undertaking to pay back the amount, as alleged by the informant, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-4th, Chapra, District-Saran, in connection with Panapur P.S. Case No.01 of 2019, subject to the following conditions:

(I) One of the bailors will be the blood relative of the petitioner.

(ii) The petitioner shall pay the amount in six equal instalments within a period of nine months from the date of his release from custody.

In case the petitioner does not pay the amount as has been undertaken by him, it shall be open to the informant to seek appropriate legal recourse, including filing an application for cancellation of bail.
