Patna High Court CWJC No.16796 of 2015(2) dt.15-09-2023 2/3 issuance of a writ in the nature of mandamus commanding and directing the Respondents concerned to re-evaluate / re- scrutinize the answer sheets of Petitioners with their respective option subject of the examination held by the B.S.S.C. in pursuant to the Advertisement No.704 of 2004 in which admittedly several questions and model questions have been found to be incorrect and on that basis result of written examination has been re- prepared re-assessing the marks obtained by candidates appeared in the examination, but Petitioners are still aggrieved by the mode of reassessment as matter of negative marking is prescribed on the basis of negative.

(2). but when the Petitioner obtained the fresh break-up of marks in their respective optional subjections then became aware that no objective mode of negative marking as prescribed in advertisement has been followed rather in unilateral manner fresh marks have been given without disclosing the number of wrong attempt answers which has caused prejudice to the valid claim of all the Petitioners as also, if the reevaluation of the answer sheets of these Petitioners will be done as per prescribed norms of negative marking then certainly these Petitioners will also come under the preview of selected candidates any other order / orders for granting any other relief / reliefs which the petitioners are found entitled to in the facts and

Though the learned counsel for the petitioners submits that the present writ petition has been rendered infructuous with the efflux of time, however, seeks liberty on behalf of the petitioners to avail such other alternative remedies as are otherwise available under the law for redressal of their subsisting grievances. Liberty, so sought, is granted. 3.

The present writ petition stands dismissed.
