The petitioner is in custody in connection with Bhagwanpur Hat P.S. Case No. 27 of 2020 for the offence under Sections 302/120(B) of the Indian Penal Code. The petitioner is the father of the deceased. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 09.02.2020. He further submits that initially the case was instituted for the offence under Section 302 of the Indian Penal, but the police after investigation submitted charge-sheet under Section 306 of the Indian Penal Code.
