The petitioners apprehend their arrest in Complaint Case No. 1167C of 2014 registered for the offences punishable under Sections 323, 379, 504, 313, 511 and 34 of the Indian Penal Code.
Fulo Devi the complainant alleged that on 06.08.2014, the accused persons entered into her house assaulted the complainant, her husband and took some articles. Learned counsel for the petitioners submits that on 09.08.2014 petitioner no. 1 Sanoj Sahani lodged Basanahi P.S. Case No. 70 of 2014 under Sections 380 and other Sections of the
Patna High Court Cr.Misc. No.26024 of 2017 (2) dt.07-07-2017 2/2 Indian Penal Code and that is why the complainant lodged this case after five days of the occurrence.
Considering the facts aforesaid and the fact that the complainant lodged the case after institution of the case lodged by petitioner no. 1 Sanoj Sahani, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saharsa in Complaint Case No. 1167C of 2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
