The petitioner seeks bail in anticipation of her arrest in connection with Mahila P.S. Case No. 87 of 2016 dated 25.06.2016 instituted for the offences under Sections 420, 471, 468, 354(B), 354(C), 354(D) and 34 of the Indian Penal Code.
From the allegations levelled in the FIR, it appears that the informant got in touch with the son of the petitioner, who taking advantage of the proximity, took her snaps and thereafter on the threat of making it viral, blackmailed her. Similar statement has been made by the informant under Section 164 Cr.P.C.
Learned counsel for the petitioner has submitted that no allegation has been levelled on the
Patna High Court Cr.Misc. No.79325 of 2018(2) dt.29-01-2019 2/2 petitioner and she has been made accused only for the reason that she is the mother of aforesaid Ashish Tyagi, the main accused.
Regard being had to the aforesaid facts, the petitioner is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-VII-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Mahila P.S. Case No. 87 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
