In this case, the petitioner is apprehending his arrest in connection with Garhpura P.S. Case No. 80 of 2016 registered for offences under sections 323/441/307/379 and 504/34 of the Indian Penal Code.
In the present case, there is a direct allegation against the petitioner that he has assaulted with iron rod on the head of the Informant's brother, namely, Rakesh Ranjan due to which the head of his brother fractured and he fell down on the ground. Looking to the direct allegation against the petitioner, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.
Patna High Court Cr.Misc. No.25090 of 2017 (2) dt.13-07-2017 Accordingly, the prayer for anticipatory bail of the petitioner, namely, Pintu Kumar is rejected.
If the petitioner surrenders before the court below, this court will consider his prayer for bail and pass an order in accordance with law on the same day of surrender itself without being prejudiced by this order.
