The petitioners apprehend their arrest in Vaishali P.S. Case No. 129.2015, registered for the offences punishable under Section 376 and other sections of the Indian Penal Code. The victim made allegation that firstly she was married with petitioner no. 1. Anil Singh, but later on, she came to know that Anil Singh was earlier married and he has got children. Thereafter, the prosecutrix was forcibly married with petitioner no. 2 and both the petitioners committed rape with her. It is submitted that the allegation is false. The victim is consenting party. She voluntarily married with both the brothers, but considering the nature of allegations made against the
Patna High Court Cr.Misc. No.40841 of 2015 (2) dt.06-10-2015 2/2 petitioners that they committed rape with her, although she was forced to marry with petitioner no. 2, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly the same is rejected.
