JUSTICE RAVI RANJAN ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in a case registered under Sections 420, 468,470 and 478 of the Indian Penal Code. Petitioner had earlier filed application for grant of anticipatory bail which was dismissed as withdrawn after some argument.

It is contended on behalf of the petitioner that prior to that a co-ordinate Bench of this Court had granted anticipatory bail to other accused persons such as , Rani Devi, Devendra Singh and Ashok Kumar Singh, a copy of the order has been appended as Annexure 5.

Petitioner admits that Annexure 5 was passed after the

Patna High Court Cr.Misc. No.31963 of 2016 (2) dt.17-08-2016 2 / 2 order dated 12.04.2016 passed in Cr. Misc. No.44086 of 2015 by this Court and Ashok Kumar Singh, co-accused, was granted bail on 17.03.2016 but that information was not given to this Court at the time of argument.

Accordingly, if the petitioner surrenders and seeks regular bail, let the aforesaid decisions of different co-ordinate Benches of this Court, appended as Annexure 5 be also considered in accordance with law by the court below without being prejudiced by the order of rejection of anticipatory bail. Learned counsel for the State does not have any objection to that.
